Probate is a legal proceeding that is used to wind up a person’s legal and financial affairs after death. In California probate proceedings are conducted in the Superior Court for the county in which the decedent lived, and can take at least eight months and sometimes as long as several years, if the matter becomes contested.
If probate is necessary, someone must come forward to start the process. If there's a will, the executor named in the will should get the ball rolling. If there's no will, or the person named to serve as executor isn't available, then usually a family member asks the court to be appointed as the “administrator” of the estate. It's the same job.
Administering a living trust in California is a straightforward process that doesn't involve probate court, thereby reducing the amount of time and expense required to distribute assets.
When the grantor dies, the living trust automatically and instantly becomes an irrevocable trust. This means that no further modifications can be made and the successor trustee will distribute assets to heirs as laid out in the trust.
